Su rapidez de construcción, eficiencia energética y, a menudo, menor coste, las convierten en una alternativa atractiva a la edificación tradicional. Sin embargo, una de las dudas más recurrentes es si es posible instalarlas en suelo rústico o no urbanizable. La respuesta corta es que, por regla general, no es legal, y las excepciones son muy limitadas y estrictamente reguladas.

Analicemos en detalle los aspectos clave para entender por qué.

1. ¿Una casa prefabricada es considerada una «edificación»?

El primer punto a desmitificar es la naturaleza jurídica de una casa prefabricada. A menudo se piensa que, al no ser construida «in situ» con ladrillo y cemento, podría considerarse un bien mueble, como una caravana, eludiendo así la estricta normativa urbanística.

La realidad, tanto legal como jurisprudencial, es muy distinta. Lo determinante no es el sistema constructivo, sino su uso residencial y su vocación de permanencia. Una vivienda prefabricada, una vez anclada al suelo y conectada a suministros básicos (agua, saneamiento, electricidad), se considera a todos los efectos una edificación.

La jurisprudencia es clara al respecto. La Sentencia Nº 44/2014 del Tribunal Superior de Justicia de la Comunidad Valenciana rechaza la «curiosa interpretación» de que una casa prefabricada de madera no es una edificación, afirmando que, al constituir una vivienda que se asienta sobre el terreno, requiere la misma licencia que cualquier otra construcción. Del mismo modo, la Sentencia de 06/10/2011 del Tribunal Superior de Justicia de Andalucía subraya que la «vocación de permanencia» y las actuaciones constructivas asociadas (preparación del terreno, conexiones, etc.) son clave para equipararla a una edificación sujeta a licencia.

2. El Régimen Protector del Suelo Rústico

El suelo rústico (o no urbanizable) tiene un régimen jurídico especial cuya finalidad es proteger sus valores agrícolas, ganaderos, forestales, paisajísticos o medioambientales. La Ley de impulso para la sostenibilidad del territorio de Andalucía,, en su Artículo 14, lo define como aquel que debe ser preservado de la transformación urbanística.

La regla general, por tanto, es la prohibición de usos residenciales que puedan inducir a la formación de nuevos asentamientos. El Artículo 20 de la Ley de impulso para la sostenibilidad del territorio de Andalucía, prohíbe expresamente las parcelaciones urbanísticas en suelo rústico, que son precisamente el resultado de dividir terrenos para crear núcleos de viviendas.

3. Las Excepciones: ¿Cuándo podría ser viable?

Aunque la norma general es la prohibición, la ley contempla ciertas excepciones muy tasadas, que deben ser interpretadas de forma restrictiva. Estas no son un «resquicio legal» para construir una segunda residencia, sino que responden a necesidades justificadas.

La principal excepción es la construcción de una vivienda familiar vinculada directa y justificadamente a una explotación agraria, ganadera o forestal.

  • Necesidad real y justificada: No basta con ser propietario de una finca rústica. Es imprescindible demostrar que la vivienda es indispensable para el desarrollo de la actividad. La Sentencia Nº 466/2014 del Tribunal Superior de Justicia de Cataluña denegó una licencia precisamente porque no se acreditó suficientemente la necesidad de la vivienda para las funciones de vigilancia, asistencia y control de la explotación, considerando que la justificación se basaba más en la «comodidad de los titulares».
  • Actuaciones ordinarias y extraordinarias: La normativa andaluza, en sus Artículo 21 y Artículo 22, regula las actuaciones que pueden llevarse a cabo. Las edificaciones residenciales necesarias para usos ordinarios (como una explotación agrícola) son consideradas actuaciones ordinarias, pero siempre deben cumplir los requisitos reglamentarios y obtener la preceptiva licencia urbanística municipal.
  • Interés público o social: En casos muy excepcionales, se podrían autorizar actuaciones de interés público o social, pero esto requiere un procedimiento complejo de autorización previa a la licencia municipal, que demuestre que no hay otra ubicación posible en suelo urbano.

4. Consecuencias de una Instalación Ilegal

Comprar una vivienda es, probablemente, la decisión financiera más importante de tu vida. Aunque el proceso para solicitar un préstamo hipotecario pueda parecer un laberinto burocrático, la legislación española actual ha diseñado un camino seguro para protegerte.

En este artículo, te explicamos paso a paso todo lo que necesitas saber: desde elegir el mejor tipo de interés hasta el significado de la FEIN y el Acta de Transparencia ante notario. Toma el control de tu hipoteca con información clara y actualizada.


1. Tipos de interés en hipotecas: ¿Fijo, Variable o Mixto?

Antes de comparar ofertas, debes decidir qué modalidad se adapta a tu economía. El Artículo 9 de la Ley reguladora de los contratos de crédito inmobiliario define las tres opciones principales:

A nota simple is an official document issued by a public organism called «Registro de la Propiedad». GETTING A NIE NUMBER

To be able to buy a property in Marbella the non-resident needs to obtain a foreigner identification number. It is a simple procedure that takes place in the immigration offices or in the police station and it takes up to 7-10 days.

SIGNING A PRECONTRACT

It is seems pretty obvious but do not pay any amount in advanced without signing a contract. In Spain we usually use a contract called CONTRATO DE ARRAS. The Arras Agreement is signed in good faith by both parties with the intention of signing the purchase sale of the property in a short period of time. But like everything else, this purchase-sale may not come about at all, either because the seller backs down and decides not to sell perhaps because he has found another buyer that pays better, or because the buyer does not find financing. In this case, article 1454 of the Spanish Civil Code establishes penalties for the breaching party. In this way, according to the Spanish legislation, if the one that breaks the agreement is the buyer, this one will lose the signal contributed by him to the signing of the Arras Contract. On the other hand, if the person who fails to comply with the agreement is the seller, the latter must not only return the signal given by the buyer, but must return twice that amount.

OPEN A BANK ACCOUNT IN SPAIN

Besides it is not mandatory, It is highly recommended in order to comply with the accreditation of payment of the purchaser in the purchase of a property in the moment to sign the de deed of sale at the notary public office, as well as for the payment of expenses and taxes inherent to the acquisition. To open a bank account you will need to provide a NIE number.

SIGNING THE CORRESPONDING DEED OF SALE BEFORE A NOTARY PUBLIC:

On the assigned day of completion, the buyer and seller (or their legal representatives ) will sign the tittle of deed in the offices of a designed notary public.

PAYING TAXES

The purchase of a property entails the payment of the following taxes, and it is amount varies depend of the nature of the property, price, etc. :

• IVA (impuesto sobre valor añadido): VAT taxes, usually at 10% .

• El Impuesto sobre Transmisiones Patrimoniales y Actos Jurídicos Documentados: he Tax on Patrimonial Transfers and Documented Legal Acts

REGISTRATION IN THE LAND REGISTRY (REGISTRO DE LA PROPIEDAD)

After the payment of transmission taxes, the property title must be registered in the Property Registry corresponding to the location of the acquired property.
